Quick answer
These terms govern painting work performed by Bighorn Painting, a Colorado limited liability company doing business as Bighorn Painting, and use of this website. Every written proposal incorporates these terms by reference. Proposals are valid for 30 days, deposits reserve scheduled dates, unforeseen conditions are priced in writing before work proceeds, and completed work carries a 5-year workmanship warranty. 1. Who you are contracting with
Painting services described on this website and in our proposals are provided by Bighorn Painting, a Colorado limited liability company, operating under the registered trade name Bighorn Painting. In Colorado a trade name is the equivalent of what many states call a DBA. References on this site to "Bighorn Painting," "we," "us" and "our" mean Bighorn Painting doing business as Bighorn Painting.

2. The agreement
Your agreement with us consists of three documents: the written proposal you receive, these terms and conditions, and any written change orders issued during the project. Where the proposal and these terms conflict, the proposal controls for that project.
Verbal statements, text messages and emails do not alter the written scope unless they are confirmed in a written change order. If something matters to you, ask for it in writing. We will put it there.
3. Proposals, pricing and validity
Proposals are free and carry no obligation. Unless the proposal states otherwise, pricing is valid for 30 days from the proposal date, after which material costs, scheduling and availability may have changed.
Pricing is based on the surfaces, measurements, conditions and quantities recorded in the proposal. Work not described in the proposal is not included. Square footage, linear footage and counts shown are working estimates taken on site; material quantities may vary without changing the agreed price.
Discounts and promotions are applied as shown on the proposal, apply to labor unless stated otherwise, and may not be combined with other offers.
4. Scope of work
A typical exterior project includes protecting the property, power washing, scraping and sanding loose material, filling and caulking, priming where required, applying the agreed number of coats to the surfaces listed, daily cleanup and a final walkthrough. A typical interior project includes protection of floors and furnishings, patching and sanding, caulking, spot priming, applying the agreed coats to walls, ceilings, trim, window and door casings as listed, daily cleanup and a final walkthrough.
The specific inclusions for your project are the ones printed on your proposal. Common exclusions unless listed: roofing, gutters, concrete coatings, window glass replacement, structural repairs, mold remediation, asbestos abatement, and painting of surfaces we have identified in writing as unsuitable.
5. Unforeseen conditions and change orders
Some conditions cannot be seen until preparation begins: rot behind trim, hidden water damage, failed substrate, undisclosed previous coatings, insect damage or structural issues. When we find them, work on that item stops and you receive the additional cost in writing before it proceeds.
Changes you request during the project are also handled as written change orders, including scope additions, color changes after purchase of materials, and additional coats.
6. Scheduling and weather
Start dates are targets, not guarantees. Colorado weather, preceding projects and unforeseen conditions can move a schedule. We will communicate changes as early as we know about them.
Exterior coatings are applied within manufacturer temperature, humidity and surface requirements. We will delay rather than apply product in conditions that compromise the finish, and such delays are not a breach of this agreement.
7. Deposits, payment and late amounts
A deposit as stated in the proposal, commonly 50%, reserves your dates and covers material procurement. The balance is due upon completion, after your walkthrough. Multi-phase or commercial projects may use progress payments as set out in the proposal.
Accepted methods are listed on the invoice. Amounts unpaid more than 30 days after completion may accrue interest at the lesser of 1.5% per month or the maximum rate allowed by Colorado law, plus reasonable collection costs.
If you cancel after materials have been custom tinted or ordered, those material costs are non-refundable. Cancellation after work has begun is billed for work completed and materials used to that point.
8. Your responsibilities as the property owner
To keep the project on schedule and on price, you agree to: provide access to the work areas and to water and power where needed; secure pets; disclose known hazards including lead-based paint, asbestos, mold and active leaks; remove or identify fragile, valuable and irreplaceable items; move vehicles clear of work areas; and obtain any HOA or association approvals required for color and scheduling.
Items you ask our crews to move are moved at your direction and we are not responsible for pre-existing damage or for items that were not disclosed as fragile.
9. Warranty
Completed projects carry a 5-year workmanship warranty covering failures caused by our surface preparation or application, such as peeling, blistering or adhesion failure on surfaces we prepared and coated, and caulk joints we installed.
The warranty does not cover: hail, wind, storm or impact damage; normal wear, fading or dirt accumulation within the coating's rated performance; damage from moisture intrusion originating outside our scope, including roof, plumbing, grading, irrigation and gutter problems; surfaces we recommended repairing or replacing that were left as-is; damage caused by others; color fade on highly saturated colors beyond manufacturer tolerances; and failures on customer-supplied materials.
Coatings carry the manufacturer's own warranty, which is separate from ours and is administered by the manufacturer. Warranty service requires that the account be paid in full. To make a claim, contact us with the property address, approximate date of work, a description and photographs.
10. Materials and color
Unless the proposal states that you are supplying materials, we purchase the products named in the proposal. We do not substitute a lower product line after signing. If a specified product becomes unavailable, we will propose an equivalent or better product in writing.
Color selection is yours. Colors render differently at Colorado's elevation and in different light, and sheens affect appearance. We strongly recommend sample approval on the actual surface before production. Repainting because a selected color is not what you pictured is a change order, not a warranty item.
Leftover material remains the property of Bighorn Painting unless the proposal states otherwise, except for touch-up quantities we leave for you.
11. Older properties and regulated conditions
Properties built before 1978 may contain lead-based paint. Where our work disturbs those surfaces, federally required lead-safe work practices apply and may affect preparation methods, containment, cleanup and price. You agree to disclose known lead, asbestos or mold conditions before work begins.
We do not perform abatement of lead, asbestos or mold. If such conditions are discovered, work in that area stops until the condition is addressed by a qualified party.
12. Insurance and liability
We carry liability insurance and provide a certificate of insurance on request. Our total liability for any claim arising out of a project is limited to the amount paid by you for that project.
We are not liable for indirect, incidental or consequential damages, including lost income, lost use or delay damages. We are not responsible for pre-existing conditions, settlement cracks, nail pops that appear after painting due to structural movement, or damage caused by conditions you did not disclose.
13. Disputes and governing law
These terms and any project agreement are governed by the laws of the State of Colorado. Before filing any action, both parties agree to attempt resolution in good faith, first directly and then through mediation in Colorado, with mediation costs shared equally.
Any action that proceeds beyond mediation shall be brought in the state courts located in Jefferson County, Colorado, and both parties consent to that venue. Any claim must be brought within one year of the date the cause of action arose.
14. Use of this website
Content, photographs, text, graphics, logos and code on this website are owned by or licensed to Bighorn Painting and are protected by applicable law. You may view, download and print pages for your own use in evaluating or managing a project with us. You may not scrape, republish, resell, frame or systematically copy the site or its content without written permission.
You agree not to use the site to transmit malicious code, to interfere with its operation, to misrepresent your identity, or to collect information about other users. The site is intended for users who are at least 18 years old.
The website is provided as-is. We make no warranty that it will be uninterrupted or error-free, and we may change or remove content at any time. Pricing information published on the site is general market context, not a quote.
15. The estimator and electronic signature
Proposals may be prepared, delivered and signed electronically, including on a phone or tablet using a finger or stylus. You agree that an electronic signature carries the same effect as a handwritten one, and that electronic delivery of proposals, change orders, invoices and notices satisfies any requirement that such documents be in writing.
A proposal link sent to you contains the details of your project so you can review and sign it on your own device. Treat that link as you would any document containing your contact and property information.
16. Your information
We collect the information needed to prepare a quote and complete a project: name, contact details, property address, project details and photographs you provide. We use it to communicate with you, prepare proposals, schedule work, and service the warranty.
We do not sell your personal information. We may use project photographs in our portfolio and marketing without identifying your address; tell us in writing if you prefer we do not. To request a copy of your information or its deletion, contact us using the details on our contact page.
17. Third-party links and content
This site links to third-party resources such as paint manufacturers and public agencies. We do not control those sites, do not endorse everything on them, and are not responsible for their content, accuracy or privacy practices.
18. Changes to these terms
We may update these terms. The version in effect on the date of your signed proposal governs that project. Continued use of the website after an update constitutes acceptance of the updated terms for website use.
